Terms of Service

These Terms of Service (“Terms”) govern your use of the LinkMotors platform operated by LinkMotors Discovery Ltd (“LinkMotors”, “we”, “us”, or “our”), a company registered in England and Wales (company number 17089038), with its registered office at A376, Unit 4-6 Greatorex Street, London, E1 5NF, United Kingdom. By accessing or using the platform, you agree to be bound by these Terms. If you do not agree, do not use the platform.

These Terms should be read alongside our Privacy Policy and Cookie Policy, which explain how we handle your data.

1. Definitions

• “Platform”: the LinkMotors website and any associated services.
• “Driver”: any person who uses the Platform to search for or view automotive service providers.
• “Provider”: any business or individual that registers a listing on the Platform.
• “Listing”: a provider's profile page on the Platform.
• “Content”: any text, images, contact details, or other material submitted to the Platform.
• “Enquiry”: a structured message a signed-in driver sends to a provider through the Platform, which may include the driver's contact details and vehicle information.

2. Use of the platform

The Platform is a discovery tool that helps drivers find automotive service providers and view their published contact details. Any contact, arrangement, or transaction between a driver and a provider takes place directly between them, away from the Platform. LinkMotors does not provide automotive services, is not a party to any agreement between a driver and a provider, does not vet or endorse providers, and does not take a fee from any service transaction.

You must be at least 18 years old to create an account. By creating an account you confirm that you meet this requirement.

3. Enquiries

Signed-in drivers can send an enquiry to a provider through the Platform. When you send an enquiry, you choose what information to include and you confirm, by a consent checkbox, that you agree to share those details with that provider so they can respond to you. We pass your enquiry and the details you include to the provider you selected, by email and in their dashboard. We do not host replies or any further conversation; the provider responds to you directly, away from the Platform.

• You will only send genuine enquiries, and will not use the enquiry feature for spam, marketing, or harassment.
• You will not include sensitive personal information, payment card details, or any information you would not want shared with the provider.
• The details you choose to include will be shared with that provider, and once sent, an enquiry cannot be recalled from a provider who has received it.

LinkMotors passes enquiries on but is not a party to, and is not responsible for, how a provider responds, whether a provider responds, or how a provider uses the details you provide. Providers are required to use enquiry details only to respond to your enquiry. To protect against misuse, we limit how many enquiries can be sent to the same provider in a day.

4. Driver obligations

Drivers using the Platform agree to:

• Use the Platform only for lawful purposes.
• Not misuse provider contact details for spam, harassment, or any purpose other than making a genuine service enquiry.
• Not attempt to scrape, crawl, or systematically extract data from the Platform without our written permission.
• Provide accurate information when creating an account, and keep account credentials secure.
• Understand that LinkMotors makes no warranty as to the quality, suitability, or reliability of any provider listed.

5. Provider obligations

Providers using the Platform agree to:

• Provide accurate and truthful information about their business, services, and contact details.
• Hold all licences, insurances, and accreditations required to provide the services listed.
• Not list services they are not legally or professionally qualified to offer.
• Keep their listing up to date and notify us promptly of any material change.
• Not engage in any conduct that is misleading, deceptive, or harmful to drivers or other providers.
• Use any enquiry and the contact details it contains only to respond to that driver's enquiry, handle those details in line with applicable data protection law, and not use enquiry details for unsolicited marketing.

6. Listing content rules

Content submitted to the Platform must not:

• Be false, misleading, or fraudulent.
• Infringe the intellectual property rights of any third party.
• Contain offensive, defamatory, or discriminatory material.
• Include personal data about individuals without their consent.
• Promote illegal activities.

We reserve the right to remove or refuse any content, or to suspend or remove any listing, that violates these rules, at our sole discretion.

7. Prohibited conduct

The following conduct is prohibited on the Platform:

• Attempting to gain unauthorised access to any part of the Platform or its underlying systems.
• Introducing malicious code, viruses, or other harmful software.
• Impersonating any person, business, or organisation.
• Using automated tools to access the Platform in a manner that places unreasonable load on our infrastructure.
• Circumventing any security or access control measures.

8. Availability and changes to the platform

We aim to keep the Platform available, but we do not guarantee uninterrupted access. We may change, suspend, or withdraw all or any part of the Platform, and may add or remove features, at any time. We may also suspend or close accounts that breach these Terms.

9. Limitation of liability

To the fullest extent permitted by applicable law:

• LinkMotors is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
• LinkMotors is not responsible for the quality, safety, or legality of services provided by listed providers, for the accuracy of any listing, or for any dispute between a driver and a provider.
• Our total aggregate liability to you for any claim arising from your use of the Platform shall not exceed the greater of (a) the total fees you paid to us in the 12 months before the claim, or (b) £100.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under the law of England and Wales.

10. Indemnity

You agree to indemnify, defend, and hold harmless LinkMotors Discovery Ltd and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Platform.

11. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top of this page and, where appropriate, notify you by email or through the Platform. Your continued use of the Platform after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of England and Wales. Any dispute arising from or in connection with these Terms is subject to the exclusive jurisdiction of the courts of England and Wales.
